Copyright registration consideration criteria

3. Full exertion of labour, knowledge, capacity, and attempt in creativity

4. The work is under a category protected by the copyright law.

5. The work does not contradict the laws and public morality.

 

The works which can be registered for copyright protection include creative works of all types such as

-       Literature (book, journal, computer program, etc.)

-       Dancing (traditional dancing poses, modern dancing poses, etc.)

-       Arts (fine art, sculpture, printing, architecture, photography, illustration, map, applied art, etc.)

-       Musical works (lyric, melody and lyric, etc.)

-       Audiovisual material (DVD)

-       Movie (DVD)

-       Sound record (CD)

-       Audiovisual media (Radio and TV programs) (DVD)

-       Other works in categories of literature, science and arts

 

The works which cannot be registered for copyright protection

1.    Idea, step, process, system, instruction, thought, principle, discovery of scientific or mathematic theory

2.    Daily news and facts which are news

3.    The Constitution and laws

4.    Rule, regulation, announcement, order, clarification and letter of ministries, bureaus, departments or any governmental or local offices.

5.    Judgment, order, decision and report of a governmental agency.

6.    Translation and gathering of items 2-5 made by any ministry, bureau, department or any governmental or local office.

 

Copyright registration procedure

1.      Fill in the following information and details

(1)     Name of copyright owner: Indicate the name, nationality, ID card number or juristic person number (as the case may be) and address of the copyright owner

(2)     Name of attorney-in-fact: In case the copyright owner authorizes the attorney-in-fact to proceed with the copyright registration, the copyright owner shall indicate the scope of power granted to the attorney-in-fact, and indicate the name, nationality, ID card number or juristic person number (as the case may be) and address of the attorney-in-fact.

(3)     Contact address in Thailand: Indicate the contact address and telephone number of the copyright owner or attorney-in-fact for following up of the documents and work, in case the document submission is not completed.

(4)     Name of work creator or his alias: Indicate the name, nationality, ID card number or juristic person number (as the case may be) and address of the work creator. In case the work creator is a juristic person, indicate the registration date of the juristic person. In case the work creator has passed away, indicate the date of death of the work creator.

(5)     Name of the joint creator or his alias: Indicate the name, nationality, ID card number or juristic person number (as the case may be) and address of the joint creator. In case there are more than 1 joint creator, indicate in this space. In case the joint creator is a juristic person, indicate the registration date of the juristic person. In case the joint creator has passed away, indicate the date of death of the joint creator.

(6)     Title of the work: Indicate the correctly-spelled title of the work to accurately indicate the work in the registration certificate.

(7)     Type of the work: Indicate the type of the work and characteristics of the work applied for copyright and indicate the work in support of the application, for example a book or CD, etc.

(8)     Copyright ownership: Indicate how the owner becomes the copyright owner, for example the creator, employer, employee, hirer or the assignee, etc.

(9)     Type of creativity: Indicate whether the creator solely or partially created the work and what part of the work he created. Or in other cases, such as, the work collector or adaptor, etc.

(10) Place of creation : Indicate the country where the work is created.

(11) Year of creation: Indicate the year when the work is created.

(12)Announcement: Indicate the date, month, year and country of the first announcement, when the work is sufficiently distributed with consent of the creator. In case of no announcement, indicate this by making a mark in the box of no announcement.

(13)Copyright notification/registration abroad: Indicate whether the owner has notified/registered the copyright in a foreign country or not, by making a mark in the box of previous notification or registration (as the case may be).

(14)Approval for the use or transfer of copyright: Indicate by making a mark in the box of previous use/transfer of copyright, for example if the owner has never approved the copyright use/transfer, then make a mark in the box of no previous approval for copyright use or transfer. If the owner has approved the copyright use/transfer, then make a mark in the box of previous approval for copyright use or transfer, and specify whom the copyright is granted or transferred to, wholly or partly, and how long.

(15)Publication of the copyright information: Indicate whether the owner allows others to inspect documents in the copyright notification and work file or not.

(16)The copyright owner or the attorney-in-fact signs in the application

2.    Annex of copyright notification: In case all information cannot be filled in the application (Lor Khor 01) or in each item, for example if there are more than one copyright owner, attorney-in-fact or joint creator, the applicant can indicate the additional information in the annex. The copyright owner or attorney-in-fact shall affix his signature in the annex.

3.    The brief details regarding work creation: Indicate the brief method and process of work creation or the inspiration of work creation. The copyright owner or attorney-in-fact shall affix his signature in this form.

4.    Certificate of copyright owner: Indicate the name, address and juristic person registration number (if any) of the copyright owner, type of copyright, title of the work, and indicate the copyright application submission date. Only the copyright owner shall affix his signature in the certificate of copyright owner.

3The work or one set of the photograph of the copyright work.
4Power of attorney with the revenue stamp of 30 Baht and copy of ID Card of the attorney-in-fact.  (with certification)
5If the applicant is a governmental agency or organization, the applicant shall submit the director appointment letter of the organization and copy of the ID card of the applicant (with certification).
